see so many people actually came to City Hall to", "start": 3243.28, "end": 3250.24}, {"text": "participate today uh as well as uh we know there are a number of people attending virtually U via the um live", "start": 3250.24, "end": 3258.24}, {"text": "stream although we couldn't celebrate on the actual day uh National Housing day", "start": 3258.24, "end": 3264.28}, {"text": "is recognized as I'm sure you know across Canada on November 22nd to raise", "start": 3264.28, "end": 3269.599}, {"text": "awareness about the housing and homelessness work that has been done and still needs to be done in communities", "start": 3269.599, "end": 3277.079}, {"text": "across Canada but we're here today uh because we couldn't uh make it happen on", "start": 3277.079, "end": 3282.48}, {"text": "the 22nd and why is it important because National Housing day is a time when we", "start": 3282.48, "end": 3287.52}, {"text": "can come together and not only reflect on the challenges we're facing as a community but it's also a time to", "start": 3287.52, "end": 3294.72}, {"text": "recognize the work that we are are doing uh that is having a positive effect", "start": 3294.72, "end": 3300.04}, {"text": "across the housing Continuum we know that there is work to", "start": 3300.04, "end": 3305.119}, {"text": "be done in our city and I'm sure you uh realize and if you don't I want to", "start": 3305.119, "end": 3310.52}, {"text": "reiterate uh this uh reality it's a priority of mine and it has been for a", "start": 3310.52, "end": 3315.96}, {"text": "long time and I'll mention very briefly later on why that is but nonetheless uh", "start": 3315.96, "end": 3321.96}, {"text": "there is a lot that needs to be done it is a priority of mine and it's a priority of City councils as well to", "start": 3321.96, "end": 3327.88}, {"text": "continue to address uh the housing challenges that we have and to maintain our commitment to action there are many", "start": 3327.88, "end": 3336}, {"text": "initiatives and Investments being made across the city of Hamilton right now to help uh those who are unhoused find", "start": 3336, "end": 3342.16}, {"text": "shelter uh such as the recent shelter expansion work that we're doing but there are also Investments that the city", "start": 3342.16, "end": 3348.4}, {"text": "is making alongside so many Community Partners and I'm so grateful for those", "start": 3348.4, "end": 3353.52}, {"text": "Community Partners uh to help house people and to help people uh maintain", "start": 3353.52, "end": 3359.64}, {"text": "their housing to help keep people housed uh this is critical work that is", "start": 3359.64, "end": 3365.2}, {"text": "absolutely uh important because it contributes to stability for people and", "start": 3365.2, "end": 3370.599}, {"text": "stability through the housing spectrum and today as we recognize National Housing day we're going to focus on some", "start": 3370.599, "end": 3377.48}, {"text": "of that work that's being done to help keep people housed uh and we're going to share some of that good work that's", "start": 3377.48, "end": 3383.599}, {"text": "occurring in our community for example the city of Hamilton 's tenant Support Program which Council approved in August", "start": 3383.599, "end": 3390.4}, {"text": "of 2023 which builds upon the successful pilot of the tenant defense fund uh I", "start": 3390.4, "end": 3397.24}, {"text": "think it's import important to acknowledge councelor Nan she's not with us today but she was certainly very very", "start": 3397.24, "end": 3403.319}, {"text": "um much a leader when it came to bringing that work forward uh and getting the suppor of council the goal", "start": 3403.319, "end": 3409.48}, {"text": "of the tenant support program is to prevent bad faith evictions and help tenants to stay informed about their", "start": 3409.48, "end": 3415.319}, {"text": "rights uh the program is directly connected to the goals and objectives of City's the city's housing and", "start": 3415.319, "end": 3420.64}, {"text": "homelessness action plan uh and the creation of the program and the accompanying bylaw enhancements were", "start": 3420.64, "end": 3427.799}, {"text": "driven by Council and as I mentioned particularly councelor Nan uh and", "start": 3427.799, "end": 3433.079}, {"text": "advance to make the city of Hamilton a national leader in creating tenant focused approaches to housing today we", "start": 3433.079, "end": 3439.88}, {"text": "are joined by our tenant Support Program Partners the H Hamilton housing help", "start": 3439.88, "end": 3445}, {"text": "center the Hamilton Community Legal Clinic and I just want to say I I", "start": 3445, "end": 3450.52}, {"text": "alluded to the fact that housing is an important priority of mine and has been for a long time many many years ago I", "start": 3450.52, "end": 3457.079}, {"text": "sat on the board of directors of the housing help center H and I also worked", "start": 3457.079, "end": 3462.48}, {"text": "at the Hamilton Community Legal Clinic and in both of those Ro roles uh was um very much focused on housing and that", "start": 3462.48, "end": 3469.319}, {"text": "was a long time ago and here we are now and we are still addressing the housing", "start": 3469.319, "end": 3474.88}, {"text": "crisis uh that has really blown up uh here in our city and across the country", "start": 3474.88, "end": 3480.319}, {"text": "and so um in some ways I'm not going to go off on a tangent I promise but in some ways we all saw this train wreck", "start": 3480.319, "end": 3486.72}, {"text": "coming a long time ago uh and now it's we're up against it and uh I'm just so", "start": 3486.72, "end": 3491.88}, {"text": "grateful that there are so many people who are trying to work together uh in collaboration with each other uh and our", "start": 3491.88, "end": 3498.359}, {"text": "city and other orders of government uh to try to address the crisis that we're in uh Acorn Hamilton another Grassroots", "start": 3498.359, "end": 3504.76}, {"text": "Community organization who's going to be sharing uh with their their work on the uh program throughout the panel", "start": 3504.76, "end": 3510.76}, {"text": "discussion a little later on we're also joined today by cmhc uh housing Secretariat as well is here uh with", "start": 3510.76, "end": 3517.96}, {"text": "Justin Lewis presenting on their housing related uh pieces uh so thank you thank", "start": 3517.96, "end": 3523.76}, {"text": "you to the program partners for making it this important work possible and to all of our presenters I mentioned a", "start": 3523.76, "end": 3530.359}, {"text": "particular Council who's been counselor who's been driving the housing issues particularly uh the tenant uh support", "start": 3530.359, "end": 3536.839}, {"text": "issues and the rent evictions bylaws Etc uh but we also have two fantastic City", "start": 3536.839, "end": 3542.44}, {"text": "councilors who are supportive of those issues joining us today councelor Craig casar and councelor Tammy Wang so thank", "start": 3542.44, "end": 3549.079}, {"text": "you uh for your support on all the housing initiatives that come forward uh to city council I know you've been there", "start": 3549.079, "end": 3555.839}, {"text": "supportive every single time so thank you for that I think we can give them a little Hand of", "start": 3555.839, "end": 3562.72}, {"text": "Applause you know without the uh guidance and advocate that Council provides we wouldn't have uh the 3576.079}, {"text": "horseshoe so it's h it's great that they uh that these two councelors were able to join us because it all takes money in", "start": 3576.079, "end": 3583.16}, {"text": "the budget and the budget is the decision of the council so um finally", "start": 3583.16, "end": 3588.44}, {"text": "and most importantly though I want to thank our community uh for folks who are attending folks who are watching the", "start": 3588.44, "end": 3594.52}, {"text": "live stream people who continue to support their fellow neighbors and re residents through uh difficult very very", "start": housing market data is to put some numbers behind some of the challenges that are occurring in the", "start": 3837.88, "end": 3843.76}, {"text": "rental market and to sort of help feed the discussion on days like today", "start": 3843.76, "end": 3849.279}, {"text": "throughout the day um definitely be available also at the end uh of the day at the networking event if you want to", "start": 3849.279, "end": 3855.039}, {"text": "have a chat about some of the stuff we're presenting in terms of our data and if there's anything else you want from me feel free to approach me", "start": {"text": "talk so I'm going to jump into some of the numbers that we collect at cmhc we do a rental market survey once a year uh", "start": 3866.64, "end": 3874.68}, {"text": "collecting data from all the rental providers in terms of vacancies rents turnover those sorts of stats also we", "start": 3874.68, "end": 3881.4}, {"text": "collect on a monthly basis the construction data which is something I'm really going to highlight today in terms of the rental supply and what's going on", "start": 3881.4, "end": 3888.279}, {"text": "in Hamilton so like I said going to show you some of the challenges in the market and then end off with some of the", "start": 3888.279, "end": 3894.44}, {"text": "positive stuff we've been noticing lately in terms of the uh Rental Supply", "start": 3894.44, "end": 3900.68}, {"text": "Here affordability is obviously the main thing that we have as a challenge in the", "start": 3900.72, "end": 3906.079}, {"text": "rental market in Hamilton uh if you look at just the vacant units that are out", "start": 3906.079, "end": 3911.52}, {"text": "there for rent um if you look at the data and you break it down by", "start": 3911.52, "end": 3917}, {"text": "percentiles and you say well what's affordable to the people that are looking for a unit you know this chart", "start": 3917, "end": 3923.079}, {"text": "is showing that if you're in that low to Mid inome bracket as a renter in", "start": 3923.079, "end": 3929}, {"text": "Hamilton there's barely anything out there if you were to look for a unit that was freshly listed on the market", "start": 3929, "end": 3935.16}, {"text": "that you could afford right a lot of the what's out there is Affordable to sort of the mid to high income renters but", "start": 3935.16, "end": 3941.48}, {"text": "those mid to lwi income renters it's something that's very challenging for them and this is data that we collect", "start": 3941.48, "end": 3947.799}, {"text": "every year in our survey and I can tell you that you know this is continuing to get sort of worse and worse as the years", "start": 3947.799, "end": 3953.92}, {"text": "go on uh which necessitates more of that supply that is sort of targeted at that", 3985.76, "end": 3991.799}, {"text": "at the rental housing starts in this region the last 10 years it falls well", "start": 3991.799, "end": 3997.799}, {"text": "short of even coming close to how many new renter households were added in the region so the supply is just not keeping", "start": 3997.799, "end": 4004.88}, {"text": "Pace with the demand and that's even accounting for those secondary rental condos that are getting put on the", "start": 4004.88, "end": 4011}, {"text": "market so if you were to take those condos out the purpose-built rental construction is far short of what you", "start": 4011, "end": 4018.279}, {"text": "need to sort of keep up with the number of new renters in the area and that's what's contributing to that affordability issue it's really just a", "start": 4018.279, "end": 4024.92}, {"text": "matter of that Supply demand Dynamic and it's been going on for such a long time that you know you're sort of digging", "start": 4024.92, "end": 4030.88}, {"text": "yourself up deole that you have to get out of one thing that's sort of a negative", "start": 4030.88, "end": 4038.52}, {"text": "consequence of all that is just the a the inability of renters to get in terms of movement in the rental Continuum and that's what this is", "start": 4056.839, "end": 4061.96}, {"text": "basically showing if you were looking at someone with different income types 50,000 75,000 100,000 and you wanting to", "start": 4061.96, "end": 4069.72}, {"text": "purchase in Hamilton what uh the real estate board calls The Benchmark condo", "start": 4069.72, "end": 4075.68}, {"text": "apartment or Benchmark townhouse which is kind of like an entry level home you're basically showing here that you", "start": 4075.68, "end": 4082.64}, {"text": "know the affordability is not there unless you get to uh again that really", "start": 4082.64, "end": 4087.96}, {"text": "high income renter is the only one that kind of can exit and move out which", "start": 4087.96, "end": 4093.24}, {"text": "again causes a sort of bottleneck in the rental market that's been happening for many years so not only is the supply in", "start": 4093.24, "end": 4100.48}, {"text": "the rental market sort of short of the number of new renters the number of new renters is High because there's not that", "start": 4100.48, "end": 4106.64}, {"text": "movement into Home Ownership now when we talk about the", "start": 4106.64, "end": 4112.278}, {"text": "supply in the market in Hamilton in terms of new construction I like to break down the", "start": 4112.279, "end": 4118.238}, {"text": "new construction into three groups on the left is the single detached semi row", "start": 4118.239, "end": 4123.4}, {"text": "which is again almost predominantly home ownership housing in terms of construction this is a 10 over the last", "start": 4123.4, "end": 4129.88}, {"text": "10 years the range of what you've seen condo Apartments is the middle purpose built rental is on the right there", "start": 4129.88, "end": 4135.6}, {"text": "that's the one I really want to focus on and there's good news and bad news in this the good news is over the last 10", "start": 4135.6, "end": 4142.758}, {"text": "years this year you had the highest amount of that kind of construction happening in the region so it's positive", "start": 4142.759, "end": 4149.44}, {"text": "because you're build you're starting to see more of that new purpose-built rental housing built in the region the", "start": 4149.44, "end": 4156.318}, {"text": "bad news is even at that high you're still sort of at a low amount you're not", "start": 4156.319, "end": 4161.798}, {"text": "enough to really again address that shortfall between how much you're building and how many new renters there", "start": 4161.799, "end": Supply coming on the market in terms of the uh rental housing", "start": 4173.92, "end": 4180.48}, {"text": "we do think looking forward that you know even next year you should see another healthy year of this", "start": 4180.48, "end": 4186.159}, {"text": "construction happening uh based on what we know from our own internal data at cmhc you know we do Finance help Finance", "start": 4186.159, "end": 4194.278}, {"text": "some of this rental housing ourselves through our programs and also we do ensure some of the private rental", "start": 4194.279, "end": 4200.64}, {"text": "housing that's done through uh developers with our insurance products So based on the stuff I see in our in", "start": 4200.64, "end": 4206.44}, {"text": "our pipeline it should be another pretty strong year for the rental housing uh but we need to really see it come up a", "start": 4206.44, "end": 4212.12}, {"text": "bit to those levels you see for sort of this the single family housing that's the kind of construction levels you need", "start": 4212.12, "end": 4219}, {"text": "in this market oh okay in terms of the National", "start": 4219, "end": 4225.719}, {"text": "Housing strategy so that's the the rental housing that cmhc has helped to fund and if you look at I just showed", "start": 4225.719, "end": 4233.719}, {"text": "you a map here with all the different uh major cities that we've helped add rental housing in the last few years so", "start": 4233.719, "end": 4240.08}, {"text": "these are uh rental projects that we've helped to fund through our our programs", "start": 4240.08, "end": 4245.48}, {"text": "and most of these announcements were either last year or this year so it's fairly adding to newer supply of rental", "start": 4245.48, "end": 4251.96}, {"text": "housing and these are just the affordable units and you can see in a market like Hamilton you know over a", "start": 4251.96, "end": 4257.12}, {"text": "thousand in the last couple years uh one of the you know obviously the strongest markets in terms of adding Supply", "start": 4257.12, "end": 4264.08}, {"text": "compared to a city like Miss Saga for example uh you know even more than a market like Kitchener so you know there", "start": 4264.08, "end": 4270.8}, {"text": "has been a fair amount that we've helped the fund in terms of affordable rental if you add in the money we've also put", "start": 4270.8, "end": 4277.84}, {"text": "towards some Market rental and repairing existing structures it's a lot bigger I", "start": 4277.84, "end": 4284.32}, {"text": "just wanted to show you that new Supply cuz again it's really about how much new creation is happening compared to the", "start": 4284.32, "end": 4291.32}, {"text": "number of uh new renters and the final slide I'll show", "start": 4291.32, "end": 4296.52}, {"text": "you just to feed the discussion too is that you know when you look at again these are the projects National Housing", "start": 4296.52, "end": 4301.639}, {"text": "strategy that we've helped to fund in terms of new affordable rental in the city of Hamilton what's interesting to", "start": 4301.639, "end": 4307.12}, {"text": "note is where it's coming from the projects are being uh funded for different uh proponents right you have", "start": 4307.12, "end": 4313.56}, {"text": "municipalities nonprofits you know private uh developers and then there's uh there's one project with an", "start": 4313.56, "end": 4320.04}, {"text": "indigenous body as well so it's good to see there's a bit of a variety I know in the past prior to this Nelson housing", "start": 4320.04, "end": 4326.44}, {"text": "strategy generally this would not look like this particularly that private developer one you wouldn't see a lot of", "start": 4326.44, "end": 4331.639}, {"text": "affordable added by that group without the help of these programs we have um so it's good to see that there's sort of", "start": 4331.639, "end": 4338.52}, {"text": "projects coming on from different proponents in the market and this is what we have to keep seeing in the", "start": 4338.52, "end": 4344.6}, {"text": "market going forward uh like I said this year was a pretty strong year but we need to see that kind of ramp up based", "start": 4344.6, "end": 4350.76}, {"text": "on our system again it looks like it will uh at least sustained into next year but we really need to see a", "start": 4350.76, "end": 4356.6}, {"text": "prolonged effort because it's been you know many years of underbuilding in this segment that's caused some of those", "start": "construction as one of the most challenging pillars to address due to increasing construction cost and higher", "start": 4571.8, "end": 4579.32}, {"text": "interest rates however it's still a key component to address the housing", "start": 4579.32, "end": 4584.6}, {"text": "challenge challenges the second pillar is the acquisition of afford affordable housing while acquiring existing rental", "start": 4584.6, "end": 4592.32}, {"text": "investment properties does not create new Supply it does slow down the erosion", "start": 4592.32, "end": 4597.4}, {"text": "of mod rent units which is happening at a significant Pace the third pillar is to preserve and", "start": 4597.4, "end": 4605.04}, {"text": "maintain existing affordable housing community housing vacancy rate is", "start": 4605.04, "end": 4610.239}, {"text": "currently at at around 6% which is significantly higher that this healthy", "start": 4610.239, "end": 4615.719}, {"text": "rate of 2 to 3% a one way to improve this vacancy rate is to repair units that are", "start": 4615.719, "end": 4623.159}, {"text": "currently offline and the fourth pillar is provide provision of housing based supports", "start": 4623.159, "end": 4629.96}, {"text": "which is one of the most important tools to end croning chronic", "start": 4629.96, "end": 4635.88}, {"text": "homelessness the housing Secretariat has the incredible Target of adding 900 new", "start": 4638.52, "end": 4646.199}, {"text": "units per year H we are planning to do that over three programs H 350", "start": 4646.199, "end": 4653.48}, {"text": "affordable units will come from the housing and homelessness action plan another 350 units will come from the", "start": 4653.48, "end": 4661.199}, {"text": "housing sustainability and investment road map and additional 200 from the housing accelerator", "start": 4661.199, "end": 4668.12}, {"text": "fund the um the Secretariat also has the goal of adding 200 supportive units over", "start": 4668.12, "end": 4676.48}, {"text": "the next three years and now to the good news over the", "start": 4676.48, "end": 4684.239}, {"text": "last year the city has seen a number of developments that have brought a number", "start": 4684.239, "end": 4689.44}, {"text": "of an significant number of units uh to Market over", "start": 4689.44, "end": 4694.6}, {"text": "450 h building permits have been been approved for additional dwelling units", "start": 4694.6, "end": 4700.159}, {"text": "City housing Hamilton has um is ready with 50 5 new units in 106 Bay Street", "start": 4700.159, "end": 4708.32}, {"text": "and there has been over 600 student units that will take pressure from the market", "start": 4708.32, "end": 4716.36}, {"text": "in addition there are a number of pro projects that are expected to be completed or break ground in 2025 which", "start": 4716.36, "end": 4723.8}, {"text": "will bring approximately 490 affordable units and over 1300 student", "start": 4723.8, "end": 4732}, {"text": "beds there are also AO proximately 1,900 rental units that are being", "start": 4732.48, "end": 4738.8}, {"text": "renovated across the city by a number of um housing providers and a 39 supportive", "start": 4738.8, "end": 4747.08}, {"text": "units will be ready early next week but actually um the king the property King", "start": 4747.08, "end": 4753.159}, {"text": "William is already receiving tenant and a new project will bring additional", "start": 4753.159, "end": 4758.8}, {"text": "supportive uh 40 units next year", "start": 4758.8, "end": 4765.32}, {"text": "in addition to all that uh in the housing sustainability and investment", "start": 4766.36, "end": 4771.8}, {"text": "rope map that was presented to council sorry the update uh that was presented", "start": 4771.8, "end": 4777.159}, {"text": "to Council on November 20th there are a number of achievements that are um we", "start": 4777.159, "end": 4783.639}, {"text": "are very proud to present ER Alex will uh present more details on some of these", "start": 4783.639, "end": 4789.36}, {"text": "achievements uh but I will mention them for example we have the creation of the afford housing development project", "start": 4789.36, "end": 4796.12}, {"text": "stream the housing accelerator fund the housing need assessment the finance and", "start": 4796.12, "end": 4801.679}, {"text": "acquisition acquisition action plan uh city house in Hamilton is on track to", "start": 4801.679, "end": 4807.6}, {"text": "repair and occupied 47 476 homes by the end of the year uh", "start": 4807.6, "end": 4814.8}, {"text": "City houseing Hamilton has also housed 646 households and has reduced also", "start": 4814.8, "end": 4821.36}, {"text": "their vacancy rate we have also worked in a government relations Communications and engagement plan there have been", "start": 4821.36, "end": 4828.6}, {"text": "several bylaws that have been reviewed or enacted with the purpose to protect", "start": 4828.6, "end": 4834.239}, {"text": "tenants the Supportive Housing account and affordable housing funds funds were approved providing much needed funding", "start": 4834.239, "end": 4841.36}, {"text": "for affordable housing and supportive projects Council also approved the creation of 192 additional shelter beds", "start": 4841.36, "end": 4849.36}, {"text": "and 80 temporary outdoor shelter spaces H also H the creation of the", "start": 4849.36, "end": 4855.239}, {"text": "municipal portable housing benefit several building condition assessments", "start": 4855.239, "end": 4860.88}, {"text": "and the ongoing renewal of uh 19 over 1900 rental units which I I had already", "start": 4860.88, "end": 4868.88}, {"text": "mentioned we have also a been identifying Municipal Surplus land that", "start": 4868.88, "end": 4874.36}, {"text": "can be used for affordable housing development and the ongoing Redevelopment of masassa Lodge as you", "start": 4874.36, "end": "consistent process that ensures Fair access to Municipal funding for all Community developers applications to the", "start": 4961.44, "end": 4968.679}, {"text": "program are now available on the opportunity for the city of Hamilton to address housing challenges across the housing Continuum headon with", "start": 5047.56, "end": 5054.6}, {"text": "$ 93.5 million in federal funding over 3 years "our incentives the housing Secretariat has also launched an Outreach campaign to", "start": 5118, "end": 5123.04}, {"text": "raise awareness and ensure the program is accessible to everyone no matter introduction of the finance and acquisition action plan Hamilton faced significant challenges in", "start": 5136.56, "end": 5143.44}, {"text": "maintaining affordable housing for every new affordable unit built we were losing 23 existing affordable units to rent", "start": 5143.44, "end": 5151.04}, {"text": "inflation and Renovations between 201 and 2021 the", "start": 5151.04, "end": 5156.36}, {"text": "city lost over 16,000 rental units priced below $750 per month the finance", "start": 5156.36, "end": 5162.28}, {"text": "and acquisition action plan is designed to change this trajectory the intent of this plan is to assist the community", "start": 5162.28, "end": 5168.8}, {"text": "sector nonprofit providers in purchasing atrisk rental properties preserving", "start": 5168.8, "end": 5174.08}, {"text": "affordability for the long term the 2-year pilot program includes preparing", "start": 5174.08, "end": 5179.6}, {"text": "for a federal rental protection plan pre-qualifying Hamilton apartment rental program also", "start": 5468.88, "end": 5474.4}, {"text": "known as harp was created in 2024 it's a full Suite of options created to address bad faith evictions", "start": 5474.4, "end": 5481.84}, {"text": "and it has a four-pronged approach the program includes enhancements to the", "start": 5481.84, "end": 5486.92}, {"text": "existing Property Standards bylaw and the vital Services bylaw amendments to the rental housing bylaw pilot program", "start": 5486.92, "end": 5493.88}, {"text": "the creation of a safe apartment bylaw and lastly the first Ontario renovation license and relocation", "start": 5493.88, "end": 5500.8}, {"text": "bylaw so these bylaws complement the uh new tenant support program that we're going to hear more about and that was", "start": 5500.8, "end": 5506.6}, {"text": "implemented in 2024 since this was passed by Council the uh the team in uh Bola Services", "start": 5506.6, "end": 5513}, {"text": "they've taken steps to hire the staff and build this brand new team uh during December and January they're going to be", "start": 5513, "end": 5518.32}, {"text": "doing ongoing education and engagement portion as part of their roll out and that's going to include website the city", "start": 5518.32, "end": 5524.119}, {"text": "website forms information packages that are going to be available to the community about these", "start": 5524.119, "end": 5530.158}, {"text": "bylaws I'm going to talk just a little bit about the ren eviction license and relocation bylaw this new Leading Edge", "start": 5530.639, "end": 5538.719}, {"text": "uh First Ontario bylaw it's going to require landlords Citywide to obtain a license from the city prior to", "start": 5538.719, "end": 5544.6}, {"text": "commencing any Ren eviction work that is required uh an n13 notice being issued", "start": 5544.6, "end": 5549.88}, {"text": "to a tenant requiring displacement as a local government we can't prohibit the landlord from issuing", "start": 5549.88, "end": 5555.639}, {"text": "an n13 but we can use it as a starting point for our engagement with them and requiring them to obtain a municipal", "start": 5555.639, "end": 5561.48}, {"text": "renovation license this is a key piece here because the new license has requirements that", "start": 5561.48, "end": 5566.679}, {"text": "will verify dis placement is necessary for the work they're trying to complete and and I'll note that this was a key", "start": 5566.679, "end": 5572.48}, {"text": "deliverable that was shared sh with us during our community engagement around the tenant Support Program So within 7 Days of issuing an", "start": 5572.48, "end": 5579.88}, {"text": "n13 a landlord must submit an application to the city and in that application they have to have their", "start": 5579.88, "end": 5585.6}, {"text": "building permit already done uh report from a professional uh so an engineer or somebody else with uh the proper", "start": 5585.6, "end": 5591.88}, {"text": "qualification stating that vacant possession is necessary a copy of the n13 that was issued and Confirmation uh", "start": 5591.88, "end": 5598.92}, {"text": "that a tenant rights and entitlement package has been delivered to the tenant so this is an expansion what would", "start": 5598.92, "end": 5604.28}, {"text": "previously have been in place without this bylaw where they just have to give the tenant an n13 so that verification", "start": 5604.28, "end": 5610.119}, {"text": "of vacant possession is is a is a big piece that this bylaw", "start": 5610.119, "end": 5615.719}, {"text": "accomplishes uh furthermore so even with the city's B of course tenants still have their existing rights under the", "start": 5616.84, "end": 5622.719}, {"text": "residential tenancies act so this includes their right of first refusal to the unit following the renovation under", "start": 5622.719, "end": 5628.92}, {"text": "section 53 of the RTA so with that arrange with that in the bylaw the landlord would be required", "start": 5628.92, "end": 5635.719}, {"text": "to make arrangements with the tenant arrangements as per the bylaw are defined by a temporary comparable", "start": 5635.719, "end": 5641.52}, {"text": "accommodation or some type of rental support for the differential payments that of a of a different spot during the", "start": 5641.52, "end": 5647.84}, {"text": "renovation for the tenant there's also a piece if the tenant does not exercise their first right of refusal where the", "start": 5647.84, "end": 5654.199}, {"text": "landlord can apply for an exemption under the bylaw so this bylaw Works to make sure that that verification process", "start": 5654.199, "end": 5660.679}, {"text": "is in piece which is uh a key component of stopping rovics which of course are", "start": 5660.679, "end": 5666.08}, {"text": "displacing individuals for um not real Renovations and so lastly I'm just going", "start": 5666.08, "end": 5672.92}, {"text": "to talk a little bit about the new safe apartment bylaw and the expansion of it um this is regarding Property Standards", "start": 5672.92, "end": 5680.28}, {"text": "and the registration of apartment buildings with the city of Hamilton the bylaw applies to all apartment buildings", "start": 5680.28, "end": 5685.96}, {"text": "and rental units uh within the city the bylaw defines apartment buildings as", "start": 5685.96, "end": 5691.36}, {"text": "purpose-built building or related group of buildings with two or more stories and six or more rental units and they", "start": 5691.36, "end": 5697.88}, {"text": "share at least one common area and can include the land on the premise uh that", "start": 5697.88, "end": 5702.96}, {"text": "the building is located on the general approach of the bylaw is to implement a", "start": 5702.96, "end": 5708.239}, {"text": "program for regularly evaluating and expecting purpose built rental programs over a multi-year cycle uh and educating", "start": 5708.239, "end": 5714.96}, {"text": "tenants so property standard concerns can be identified early and on a regular proactive basis through mandatory", "start": 5714.96, "end": 5722.119}, {"text": "registration the bylaw when rolled out is expect to contribute to reducing the Run eviction issue over the long term by", "start": 5722.119, "end": 5729.36}, {"text": "ensuring that the existing buildings are maintained and the quality and standard of substandard building conditions is", "start": 5729.36, "end": 5737.04}, {"text": "improved so I just like to thank the our friends in be having today is going to be moderated by Mike Jones", "start": 5774.4, "end": 5781}, {"text": "who's the manager of housing of the Housing Services tenant support program and I'm going to invite Mike up here and", "start": 5781, "end": 5787.48}, {"text": "actually ask him to introduce our three panelists today um and to uh moderate", "start": 5787.48, "end": 5792.639}, {"text": "the I'm Mike Jones", "start": 5802.719, "end": 5809.679}, {"text": "I'm the manager of tenant supports uh with the city of Hamilton so the tenant support program is a relatively new", "start": 5809.679, "end": 5816.239}, {"text": "program and so um it's really built off of the the backs of the tenant defense", "start": 5816.239, "end": 5822}, {"text": "fund and which was a bit more ad hoc and so this is kind of a formalized attempt at um streamlining resources into", "start": 5822, "end": 5829.679}, {"text": "supporting tenants so what that means in practice is supporting ten tenants", "start": 5829.679, "end": 5834.92}, {"text": "through uh preventing bad faith evictions uh helping them to understand their rights through Outreach and", "start": 5834.92, "end": 5840.4}, {"text": "educational campaigns uh and to support first r refusal so that tenants can return to their units uh when a", "start": 5840.4, "end": 5846.76}, {"text": "renovation is occurring um and so to do this work uh we rely on the support of Our Community", "start": 5846.76, "end": 5852.52}, {"text": "Partners and so as Brienne mentioned we're we're supported here through uh", "start": 5852.52, "end": 5857.639}, {"text": "Acorn um the housing heal Center of Hamilton and surrounding area and then the Hamilton Community Legal Clinic and", "start": 5857.639, "end": 5864.88}, {"text": "so each of these Partners perform uh a really indelible role in terms of what we're trying to accomplish as a city to", "start": 5864.88, "end": 5870.44}, {"text": "protect tenants um and I'll introduce each of uh the staff that are here to support us", "start": 5870.44, "end": 5876.119}, {"text": "today so they've been really gracious to come and uh participate in this uh moderated discussion um and so we have", "start": 5876.119, "end": 5882.88}, {"text": "Ashley Wilson from the Hamilton Community Legal Clinic uh Katherine French from housing heal Center Hamilton", "start": 5882.88, "end": 5889.159}, {"text": "and area and Gabrielle mayor Maguire from Acorn uh and I thank them all for being here today thank you guys um and", "start": 5889.159, "end": 5896.84}, {"text": "so I'll dive into our discussion um I'm just so I'm hoping to highlight some of the gaps that uh the tenant Support", "start": 5896.84, "end": 5903.239}, {"text": "Program s looking to fill uh and also share some of the pressures that tenants are experiencing in our city uh as a", "start": 5903.239, "end": 5910.159}, {"text": "result some of the presentations we've seen already today and and the the rental market and some of that um and", "start": 5910.159, "end": 5916.719}, {"text": "then talk about uh some of the pressures after they do uh find uh a place to live", "start": 5916.719, "end": 5922.36}, {"text": "uh some of those pressures they experience in that realm as well uh and then also hopefully Identify some uh", "start": 5922.36, "end": 5929.199}, {"text": "strategies to mitigate conflict and prevent evictions um um so with that", "start": 5929.199, "end": 5934.92}, {"text": "said um I'm first going to move into uh asking our panelists to explain their role within the tenant Support Program", "start": 5934.92, "end": 5942.28}, {"text": "uh talk a bit about their organization's role and what the their mandate is and what they're looking to fulfill um and", "start": 5942.28, "end": 5948.52}, {"text": "then talk about what what impact that has so um I'll let all of you do uh do", "start": 5948.52, "end": 5953.76}, {"text": "your best to describe that maybe I'll start with Ashley awesome um thanks so much Mike so", "start": 5953.76, "end": 5960.56}, {"text": "my name is Ashley Wilson I'm a lawyer with the Hamilton Community Legal Clinic I work on housing matters um through the", "start": 5960.56, "end": 5966.08}, {"text": "generous support of the city with the um tenant Support Program myself and my colleague Kevin stats who's a pargal are", "start": 5966.08, "end": 5973.04}, {"text": "able to work on some issues that the clinic has has not previously been able to support with so in particular um my", "start": 5973.04, "end": 5979.36}, {"text": "program helps with n12 evictions so those are evictions where a landlord or", "start": 5979.36, "end": 5984.4}, {"text": "a purchaser says they're planning to move into um an existing rental unit we also help with n13 evictions so those", "start": 5984.4, "end": 5991.4}, {"text": "are um somewhat um what James was talking about where the landlord says they're going to do either you know", "start": 5991.4, "end": 5997.48}, {"text": "really extensive repairs where vacant possession is required for the rental unit and the people need to leave um or", "start": 5997.48, "end": 6003.239}, {"text": "there's going to be a demolition those can also happen um we're also um empowered to support tenants with T2 and", "start": 6003.239, "end": 6009.92}, {"text": "T6 applications so those are tenant applications where the landlord might not be fulfilling their duties when it", "start": 6009.92, "end": 6015.48}, {"text": "comes to maintenance repairs um or the landlords interfering with the tenants reasonable enjoyment so that could be", "start": 6015.48, "end": 6022.08}, {"text": "illegal entries into the unit that kind of thing and then finally the big thing that we help with now um are above", "start": 6022.08, "end": 6027.159}, {"text": "guideline increases so that's where you see um landlords trying to recoup um", "start": 6027.159, "end": 6032.639}, {"text": "huge costs um of you know big repairs that they're doing on the building but then those costs all get borne by the", "start": 6032.639, "end": 6038.92}, {"text": "tenants instead of the landlord um paying for those expenditures through the profits that they're making every", "start": 6038.92, "end": 6044.639}, {"text": "month um through the rents in their building so that's something new that the clinic has been able to help with um through this program we're really happy", "start": 6044.639, "end": 6050.48}, {"text": "to be able to do that so myself and Kevin uh we help tenants both by providing kind of summary advice to them", "start": 6050.48, "end": 6055.76}, {"text": "at initial stages when they have questions about their tency up to full representation at their hearings um if", "start": 6055.76, "end": 6062.679}, {"text": "they're facing eviction or they're facing above guideline increases or any of the other things that the the program covers so that's what we do thanks Mike", "start": 6062.679, "end": 6070.04}, {"text": "thanks Ashley uh maybe we'll move to Katherine hi thanks Mike um yeah so my", "start": 6070.04, "end": 6076.56}, {"text": "name is Katherine French I'm a housing worker at the Hamilton housing help center as an organization we prioritize", "start": 6076.56, "end": 6082}, {"text": "helping prevent evictions and keeping people housed in the current climate uh that can be difficult as everyone uh", "start": 6082, "end": 6088.679}, {"text": "knows with the rising cost of living and the different uh structural barriers that people face on a day-to-day basis", "start": 6088.679, "end": 6094.48}, {"text": "um so we work to provide educational supports on rights and responsibilities for both landlords and tenants to make", "start": 6094.48, "end": 6100.4}, {"text": "sure that everyone is informed of um what their role is whether it be housing provider or a tenant and what they can", "start": 6100.4, "end": 6106.679}, {"text": "um have access to within their unit um we also provide assistance with uh rehousing or keeping people housed in an", "start": 6106.679, "end": 6114.48}, {"text": "instance where they might be at risk of eviction um so a lot of what we do is within the tenant support program as", "start": 6114.48, "end": 6120.239}, {"text": "well and a lot of what my work is with this is an intensification of the housing help centers uh foundations", "start": 6120.239, "end": 6126.48}, {"text": "which is great we're building um more help for people within the city initiatives uh and we can also provide", "start": 6126.48, "end": 6132.56}, {"text": "help for finding temporary housing and rehousing supports for people that are displaced by these notices a lot of what", "start": 6132.56, "end": 6137.8}, {"text": "I've seen is people that have been in their units for close to a decade or longer or have never had um situations", "start": 6137.8, "end": 6144.8}, {"text": "like this in their lives they did have never seen an eviction notice have no idea what's going on so being able to provide the um educational supports and", "start": 6144.8, "end": 6152.04}, {"text": "to help build the confidence through the understanding of what the process is how they can be supported throughout the", "start": 6152.04, "end": 6157.36}, {"text": "process uh more specifically with um landlord in tenant board forms if that's something that they need help with um", "start": 6157.36, "end": 6163.84}, {"text": "helping with n n12 n13 general education or help supporting with housing plans", "start": 6163.84, "end": 6169.08}, {"text": "through the process getting rehoused either temporary or permanently depending on their situation uh", "start": 6169.08, "end": 6174.36}, {"text": "assisting with the right to First refusal and uh also Financial supports were necessary for above guideline", "start": 6174.36, "end": 6180.239}, {"text": "increases that have um affected them really negatively with the lump sum that they weren't expecting and uh General", "start": 6180.239, "end": 6186.56}, {"text": "eviction prevention as well thank you for that Katherine uh", "start": 6186.56, "end": 6194.199}, {"text": "Gabrielle hi I'm Gabrielle I'm the lead tenant defense organizer with Acorn Hamilton um acorn's All About You Know", "start": 6194.679, "end": 6202.32}, {"text": "creating po by organizing uh people and we also uh help advocate for social and", "start": 6202.32, "end": 6211.08}, {"text": "financial Justice for low and moderate income people um so through the tenant support program we help bring tenants", "start": 6211.08, "end": 6216.599}, {"text": "together and make sure they know their rights to stay in their homes and fight for better housing standards we do that through like direct Outreach we go into", "start": 6216.599, "end": 6223.119}, {"text": "buildings we knock door too um we help distribute educational materials and we answer any questions that people have", "start": 6223.119, "end": 6229.56}, {"text": "and we sort of refer them to other supports like the other partners in the tenant Support Program thank you thanks Gabrielle so I think", "start": 6229.56, "end": 6236.08}, {"text": "like to start off our discussion while obviously attendant support program is focused on tencies meaning people within", "start": 6236.08, "end": 6243.28}, {"text": "rental housing I think it's helpful and we've heard a bit about it today but to talk about the the barriers barriers", "start": 6243.28, "end": 6249.08}, {"text": "tenants experience AC acquiring housing and kind of getting into rental housing because I think and you'll hear more", "start": 6249.08, "end": 6255.76}, {"text": "from the panelist but that process actually impacts how Tendencies go as well and so it's helpful to find to hear", "start": 6255.76, "end": 6261.639}, {"text": "that context to be able to understand the fome part of the tennis support program so I'll throw that to our panel", "start": 6261.639, "end": 6267.76}, {"text": "Gabrielle I'll throw that to you if that's okay yeah so a lot of what we see in", "start": 6267.76, "end": 6276.92}, {"text": "people like having challenges attempting to move into Market housing or just find somewhere else to live um the increase", "start": 6276.92, "end": 6283.159}, {"text": "in cost like that's increased exponentially in the past 5 years even", "start": 6283.159, "end": 6288.36}, {"text": "um insufficient social assistance rates like I said we work primarily with low and moderate income people and that's who we are seeing have the this have the", "start": 6288.36, "end": 6295.52}, {"text": "largest impact on as Katherine mentioned it's people who have been in their units for a very long time they're paying well below Market rent and so being displaced", "start": 6295.52, "end": 6301.96}, {"text": "from their homes is incredibly challenging for them they often don't have the income to support moving into a", "start": 6301.96, "end": 6307.76}, {"text": "market pric rental um there's a lack of affordable options so you know the", "start": 6307.76, "end": 6313.88}, {"text": "choices that they have to look from are very slim um we see discrimination you", "start": 6313.88, "end": 6319.119}, {"text": "know there's often people are asking for like credit ratings they want to see proof of inome come uh more and more", "start": 6319.119, "end": 6324.679}, {"text": "we're seeing people be denied simply because they're receiving social assistance and that's not explicitly", "start": 6324.679, "end": 6329.8}, {"text": "stated as the reason but um it's just like that income threshold is not enough", "start": 6329.8, "end": 6334.92}, {"text": "to afford and therefore landlords are choosing to rent elsewhere um discrimination based on family size", "start": 6334.92, "end": 6340.32}, {"text": "there so many things but tenants with complex disabilities or mental physical health challenges in particular um have", "start": 6340.32, "end": 6347.48}, {"text": "a very difficult time because they face even more barriers than what they can move into they might have specific needs", "start": 6347.48, "end": 6354.239}, {"text": "they need in the housing that they're looking for um and those are things that aren't like accommodating very specific", "start": 6354.239, "end": 6360.159}, {"text": "um accessibility concerns like that isn't something that a landlord in the private rental market necessarily does", "start": 6360.159, "end": 6366.119}, {"text": "out of obligation it's not kind of standard um and those can be things that would be expensive to implement and", "start": 6366.119, "end": 6372.32}, {"text": "therefore again we're seeing it's in the landlord's best interest they have Financial motive to", "start": 6372.32, "end": 6377.52}, {"text": "Simply rent elsewhere or choose a different tenant um I'll pass that on to someone", "start": 6377.52, "end": 6383.599}, {"text": "else for now that to say like I think that's", "start": 6383.599, "end": 6389}, {"text": "really uh useful uh in terms of describing some of the barriers uh that people face when looking to uh find a", "start": 6389, "end": 6395.76}, {"text": "tendency for themselves or their family um moving through that process then like", "start": 6395.76, "end": 6401.92}, {"text": "um let's say somebody does go through the process of finding a place that is suitable um and they they like the place", "start": 6401.92, "end": 6409.48}, {"text": "and they see it potentially with a realtor a landlord um and they want to sign a lease I think it's helpful to", "start": 6409.48, "end": 6415.92}, {"text": "walk through that process so what types of things are found within a standard uh lease developed by the province of", "start": 6415.92, "end": 6422.48}, {"text": "Ontario now uh what are the types of issues that tenants should be alerted to in saning a lease um and is there some", "start": 6422.48, "end": 6429.04}, {"text": "advice we can give to tenants uh in terms of what to look what to look out for any kind of red flags that can", "start": 6429.04, "end": 6434.48}, {"text": "appear on on a leaser in that process of signing a lease um maybe Ashley I'll start with you yeah thanks Mike um so", "start": 6434.48, "end": 6442.639}, {"text": "you um I'm going to start even a little bit before your question and kind of tag on to what Gabrielle was saying because", "start": 6442.639, "end": 6448.4}, {"text": "um it is super common to see people experiencing discrimination at those very initial stages of having", "start": 6448.4, "end": 6454.56}, {"text": "conversations with landlords and we know that the Human Rights Code protects people from experiencing discrimination", "start": 6454.56, "end": 6459.84}, {"text": "from being denied housing because they're in receipt of ODSP or ow um", "start": 6459.84, "end": 6465}, {"text": "there's protections like several people sharing a unit a bedroom turning living space into sleeping areas uh", "start": 6657.4, "end": 6663.52}, {"text": "simply to get by and they're usually afraid to speak up out of fear um from itation from the landlord um they may", "start": 6663.52, "end": 6670.8}, {"text": "not know their rights or they may know that it's illegal but they don't act have confidence that their that lack of affordable housing lack of options and so it really feels like a life or death situation in", "start": 6682.599, "end": 6690.199}, {"text": "these cases so they talents are willing to tolerate a lot simply because the", "start": 6690.199, "end": 6695.239}, {"text": "competition is so high to find a rental and um that's dangerous because spending", "start": 6695.239, "end": 6701.32}, {"text": "almost everything they have on housing and not having that Financial buffer for emergencies can put tenants in a really", "start": 6701.32, "end": 6707.719}, {"text": "precarious position if any unexpected spense expenses come up or you know the", "start": 6707.719, "end": 6712.76}, {"text": "cost of any other living Necessities increases um obviously if they miss or", "start": 6712.76, "end": 6718.239}, {"text": "are late on a rent payment that puts their tency at risk uh they can be evicted for nonpayment and so people are stock", "start": 6718.239, "end": {"text": "rental agreement with a landlord um and pets being the example of where tensions can potentially occur uh once in the", "start": 6756.28, "end": 6763.159}, {"text": "unit um are there ways uh that you all have found to that tenants and landlords", "start": 6763.159, "end": 6769.44}, {"text": "can look to deescalate some of those conflicts um what are what are some of those strategies and then like what what", "start": 6769.44, "end": 6776.36}, {"text": "are the outcomes if if deescalation doesn't work um maybe I'll start with", "start": 6776.36, "end": 6782.92}, {"text": "Ashley um yeah thanks Mike so um other than paying rent kind of the things that come up most often um where landlords", "start": 6782.92, "end": 6789.92}, {"text": "and tenants find themselves in dispute are accommodated under the Human Rights Code so when we're looking at things like cleanliness hoarding um kids those are", "start": 6815.679, "end": 6823.56}, {"text": "often things that the tenants uh may need support with or may need accommodation for um and you can really", "start": 6823.56, "end": 6829.92}, {"text": "kind of be proactive about that by having conversations with your land landlord so um you know if kids are", "start": 6829.92, "end": 6835.92}, {"text": "being loud the question is are they just being kids or is there something more going on is there a way to negotiate and", {"text": "there's going to have to be some additional leniency for um and and when you're talking about things like", "start": 6854.599, "end": 6859.92}, {"text": "hoarding usually there's mental health so having those convers ation with your landlord even though they're difficult to try to make sure you're asserting", "start": 6859.92, "end": 6865.599}, {"text": "your right to be accommodated 7026.36}, {"text": "responsibilities a landlord to try to maintain that so kind of being able to see those perspectives but understanding", "start": 7026.36, "end": 7031.719}, {"text": "that there are hard lines to what are tenant rights that need to be followed and need to be maintained that's why it's really important like Ashley", "start": 7031.719, "end": 7037.76}, {"text": "mentioned to seek legal advice when you're not sure of something like that um and to understand that your perspective is not necessarily from", "start": 7037.76, "end": 7044.56}, {"text": "either side the only one that uh so let's um", "start": 7067.32, "end": 7073.32}, {"text": "let's assume a scenario where a tenant receives notice from their landlord they're they're going to be undertaking significant repairs to their unit um or", "start": 7073.32, "end": 7080.88}, {"text": "renovations to the unit and as a result the tenant will be required to leave while this work takes place um what what", "start": 7080.88, "end": 7087.28}, {"text": "are some of the next steps and uh what are some of the key responsibilities for the tenant and landlord um and for us uh", "start": 7087.28, "end": 7094.719}, {"text": "Katherine and housing help center will be our key partner in kind of working with tenants and landlords through that process so I'll I'll give it to her to", "start": 7094.719, "end": 7101.32}, {"text": "explain a bit further there yeah so like it was mentioned in the earlier presentation on the um", "start": 7101.32, "end": 7107.32}, {"text": "relocation and renovation bylaw uh landlords have to within 7 Days of filing an n13 um file for their um", "start": 7107.32, "end": 7115.079}, {"text": "permit for the by within the bylaw um and they also have to be able to prove within the n13 and the LTB process that", "start": 7115.079, "end": 7122.56}, {"text": "their Renovations are not only necessary but they are necessary to remove the tenant as well so they have to be able", "start": 7122.56, "end": 7127.88}, {"text": "to show that the renovations that they are doing have cause and are um significant enough that the tenant", "start": 7127.88, "end": 7134.4}, {"text": "absolutely must be displaced from their unit um in a case where that is is true", "start": 7134.4, "end": 7140.119}, {"text": "there is something extensive the walls need to be taken out the floors need to be taken out and the LTB does decide", "start": 7140.119, "end": 7145.36}, {"text": "that it is uh necessary uh tenants have something which is called a right to First refusal and the good thing about", "start": 7145.36, "end": 7151.28}, {"text": "the process for this is that the tenant can do it themselves um and for tenants that need assistance with that we also", "start": vacating the unit that states that they're looking to move back into the unit at the current cost when the", "start": 7162.56, "end": 7168.32}, {"text": "renovations are done and that's built within the residential tencies act it's a protection for tenants and it also", "start": 7168.32, "end": 7174.28}, {"text": "protects the stock of affordable housing within Hamilton if those letters are are delivered that means that when the renovations are done the landlord then", "start": 7174.28, "end": 7180.8}, {"text": "has the obligation to make sure that that person gets the right to First refusal of that unit when they are", "start": 7180.8, "end": 7186.239}, {"text": "moving back in I believe as long as there's no demolition or change to the unit yeah for for the that type of speci", "start": 7186.239, "end": 7192.04}, {"text": "spefic stuff we do refer to the legal clinic but for the right to First refusal process we can help tenants and help them through that process help them", "start": "assist them with that move a lot of the people that are in these units have been there for a really long time and like I said it's a a bit of a daunting process", "start": 7205.239, "end": 7211.96}, {"text": "and Gabrielle mentioned earlier there's definitely a difficulty with finding affordable housing units as for people", "start": 7211.96, "end": 7217.199}, {"text": "that are currently in them there very very few and far between if there are any so um it's it's a great protection", "start": 7217.199, "end": 7223.239}, {"text": "that's built within the RTA and it's something that we can help with through this program as well yeah thank you for that and I think um in terms of bylaw I", "start": 7223.239, "end": 7230.92}, {"text": "know um Municipal bylaw will be doing work in terms of educating landlords and that's something also the housing help", "start": 7230.92, "end": 7236.28}, {"text": "center does because there's many different types of landlords and some may not even be aware of what this", "start": 7236.28, "end": 7242.719}, {"text": "process means and so um to ensure that uh landlords are aware housing help", "start": 7242.719, "end": 7248.04}, {"text": "centers doing workshops with landlords to kind of bring them up to speed with what the expectations are of the bylaw", "start": 7248.04, "end": 7253.44}, {"text": "and kind of what that means for them in terms of the process so um work on both ends I think for housing help center um", "start": 7253.44, "end": 7261.4}, {"text": "so I think um we I talked about this bit in the intro but uh one of our mandates is to support uh bad faith evictions and", "start": 7261.4, "end": 7269.76}, {"text": "I think like that's a bit of jargon and so I wanted to really just kind of unpack that process a bit to say excuse", "start": 7269.76, "end": 7276.28}, {"text": "me um to talk about what are these specific type of evictions um what makes", "start": 7276.28, "end": 7281.92}, {"text": "makes them bad faith uh how can they be managed and mediated um and trying to understand", "start": 7281.92, "end": 7287.599}, {"text": "who's most impacted in our community and who's most vulnerable to them um and so I'll ask Ashley to maybe get us started", "start": 7287.599, "end": 7294.599}, {"text": "yeah thanks Mike so um these are the kind of evictions that the tenant supp support program is specifically aimed at", "start": 7294.599, "end": 7301.239}, {"text": "targeting so these are those um n12 and n13 evictions so that's when the", "start": 7301.239, "end": 7306.28}, {"text": "landlord says they're going to move in or a purchaser is going to move in or when they say they're going to do Renovations and repair that are so", "start": 7306.28, "end": 7312.48}, {"text": "extensive that they need the tenant to move out and the reason that bad faith comes into play in these um evictions is", "start": 7312.48, "end": 7318.719}, {"text": "because what the landlord is is saying is not always true oftentimes what we", "start": 7318.719, "end": 7324.32}, {"text": "found is that landlords try to use these eviction processes as a way to undermine what Katherine referred to as the", "start": 7324.32, "end": 7329.52}, {"text": "affordable housing stock so they want to get those people out of their units in order to be able to raise the rent to", "start": 7329.52, "end": 7334.92}, {"text": "Market rent and so you're looking at people who have been in units for a really long time sometimes 10 20 30", "start": 7334.92, "end": 7341.32}, {"text": "years um and because of that they've had they' they've received the benefit of uh", "start": 7341.32, "end": 7347.4}, {"text": "only having the rent raised every year by that guideline and so sometimes they'll be paying well below Market rent", "start": 7347.4, "end": 7353.76}, {"text": "so the landlord is really incentivized to get them out out of there so that they can charge a whole lot more money", "start": 7353.76, "end": 7359.679}, {"text": "and what that means for those people is usually homelessness there's there's no other kind of equal affordable housing", "start": 7359.679, "end": 7366.239}, {"text": "that those people can go into when we're looking at people who have been in the same unit for sometimes even five five", "start": 7366.239, "end": 7371.52}, {"text": "10 years can really put somebody out of the rental market so um it's really", "start": 7371.52, "end": 7376.76}, {"text": "important that we have support to be able to help people um who are facing these evictions to find out is this", "start": 7376.76, "end": 7382.639}, {"text": "really um you know a good faith the landlord really does intend to move into this unit or is this a matter of getting", "start": 7382.639, "end": 7389}, {"text": "that tenant out of there and then jacking up the rent and removing that affordable housing and making somebody homeless so um that's really our job um", "start": 7389, "end": 7397.639}, {"text": "is to kind of figure out what's going on in these in these specific scenarios with n 13s as well we we find that", "start": 7397.639, "end": 7403.8}, {"text": "there's certain landlords that are you know continuously doing these n3s saying they're going to do these repairs and", "start": 7403.8, "end": 7409.079}, {"text": "what they're really hoping is that people are not going to exercise the right of first refusal or they're not going to allow people to exercise the", "start": 7409.079, "end": 7414.679}, {"text": "right of first refusal and then take that housing off of the um kind of the the the affordable housing market so um", "start": 7414.679, "end": 7421.92}, {"text": "if um so that's what the legal clinic is here for when people are are facing that and then Acorn is excellent at kind of", "start": 7421.92, "end": 7427.48}, {"text": "helping tenants to organize and realize what their rights are um at the starting point when they're when they're facing", "start": 7427.48, "end": 7467.559}, {"text": "so Acorn did a freedom of information request from the landlord and tenant board and compiled some data and we've", "start": 7467.559, "end": 7473.28}, {"text": "seen a 300% uh increase in Ren evictions provincewide since 2017 and Hamilton is", "start": 7473.28, "end": 7480.76}, {"text": "the city with the second most Ren evictions happening provincewide so that was like disproportionately for Hamilton", "start": 7480.76, "end": 7486.199}, {"text": "the uh method preferred method of bad faith eviction so we had conern concerns", "start": 7486.199, "end": 7492.199}, {"text": "about a shift to Dem eviction or condos um with the new bylaw coming in", "start": 7492.199, "end": 7497.48}, {"text": "place and uh just wanted to commend all the city staff and counselors for", "start": 7497.48, "end": 7502.96}, {"text": "joining us in a proactive approach to sort of address that with the um rental", "start": 7502.96, "end": 7508.44}, {"text": "housing protection bylaw as well and um yeah Acorn has been", "start": 7508.44, "end": 7514.119}, {"text": "organizing and supporting tenants through Ren evictions for a little over", "start": 7514.119, "end": 7520}, {"text": "six years I believe and um I just wanted to point out that the right of first refusal as Katherine and Ashley", "start": 7520, "end": 7526.239}, {"text": "mentioned and uh landlords are sort of trying to circumvent that we have yet to", "start": 7526.239, "end": 7532.04}, {"text": "see in those six years a case um where a tenant actually was able to return to", "start": 7532.04, "end": 7538}, {"text": "the unit as supposed to happen um and so back to what I was talking about", "start": 7538, "end": 7543.4}, {"text": "before um we're seeing primarily that this is impacting lowincome people", "start": 7543.4, "end": 7549.44}, {"text": "usually fixed income so that's social assistant ODSP ow um retired seniors on a pension a lot", "start": 7549.44, "end": 7557.48}, {"text": "of those people have disabilities um and that makes it really challenging", "start": 7557.48, "end": 7564.159}, {"text": "for them to move out of those generally very long-term rentals", "start": 7564.159, "end": 7569.679}, {"text": "um into the market because again there's a lack of affordable options and yeah", "start": 7569.679, "end": 7575.76}, {"text": "among those as well we see people like new immigrants um people who may have a", "start": 7575.76, "end": 7580.8}, {"text": "language barrier just absolutely no knowledge of their rights are also being exploited uh things that I would be thinking about", "start": 7672.239, "end": 7677.679}, {"text": "when I when I'm talking to a client but um the legal process is actually quite easy for for tenants um you know 7691.8}, {"text": "on the landlord tenant Board website detailing what has happened so it's pretty easy to get the process started", "start": 7691.8, "end": 7697.639}, {"text": "um and the clinic is there to support people with filling out those forms starting the process if the landlord is", "start": 7697.639, "end": 7703.32}, {"text": "failing to to deal with maintenance issues and I know Gabrielle is going to talk about more specifically what those maintenance issues are um uh again when", "start": 7703.32, "end": 7710.84}, {"text": "I say it's easy it's not easy for all tenants there's lots of people who don't have access to computers who have language barriers one of the things that", "start": 7710.84, "end": 7717.239}, {"text": "I will say um spefic because Gabrielle brought it up um so many um tenants will", "start": 7717.239, "end": 7722.559}, {"text": "have language barriers they won't realize what exactly is going on they won't know what process they're going", "start": 7722.559, "end": 7727.599}, {"text": "through the clinic actually has the ability to provide immediate phone translation in almost any language so um", "start": 7727.599, "end": 7733.92}, {"text": "if they can get to us we're able to kind of explain to them what's going on um and yeah we can help them fill out those", "start": 7733.92, "end": 7739.639}, {"text": "forms so start kind of thinking about you know how long has the landlord known about this how serious is the issue um", "start": 7739.639, "end": 7745.76}, {"text": "and those are kind of the things you're going to want to think about before beginning attendant application but it's pretty easy to get started if your landlord's not um folling through on", "start": 7745.76, "end": 7752.36}, {"text": I think tenants complaining about uh vital", "start": 7757.84, "end": 7763.199}, {"text": "services so lack of heat in the winter uh Plumbing issues water being shut off sometimes water leaks um they may have", "start": 7763.199, "end": 7769.84}, {"text": "structural concerns about the Integrity of the building some of these buildings are very old um Pest Management a lot of", "start": 7769.84, "end": 7776.079}, {"text": "bug concerns bed bugs cockroaches Even Rats in some buildings we've heard um", "start": 7776.079, "end": 7781.239}, {"text": "broken appliances sometimes there are lights in the hallways or outdoor entryways to the", "start": 7781.239, "end": 7786.8}, {"text": "building that raise safety concerns for tenants um we've seen parking issues whether that's like degradation of the", "start": 7786.8, "end": 7793.159}, {"text": "parking lot and tenants lose access to their parking there's no parking in the building or uh parking garages", "start": 7793.159, "end": 7798.8}, {"text": "underground may become unstable um garbage collection issues so whether that's shoots in the building", "start": 7798.8, "end": 7804.639}, {"text": "being broken not being fixed or um larger buildings failing to have the garbage come collected on a regular", "start": 7804.639, "end": 7811.719}, {"text": "basis um I think that's most of it yeah and I just just to follow up on that I", "start": 7811.719, "end": 7816.96}, {"text": "think this is where the uh the formalization of the program is super helpful to have partners on board that", "start": 7816.96, "end": 7822.52}, {"text": "acorn in doing some of the Outreach to inform tenants of uh what their rights are in regards to all these issues and", "start": 7822.52, "end": 7828.36}, {"text": "then being able to forward some of those uh concerns to the legal clinic to have them take it on as well um I think", "start": 7828.36, "end": 7835}, {"text": "that's one of the big gaps that we're seeing uh that could be potentially 7854.52}, {"text": "have um and then some places as we know and I think it's been alluded to may not be exactly decode but it's hard tenant", "start": 7854.52, "end": 7861.28}, {"text": "may not know that like is there an approach a tenant should take and maybe I'll give it to you Ashley yeah thanks", "start": 7861.28, "end": 7867.28}, {"text": "Mike I think this um question kind of raises a common misconception so really tenants in those situations are in as", "start": 7867.28, "end": 7874.52}, {"text": "good a situation as anybody it doesn't matter if you have a signed lease agreement if you've got an ongoing tency the tency exists lease agreements can be", "start": 7874.52, "end": 7881.88}, {"text": "um created orally um if your if your unit isn't up to code um that doesn't", "start": 7881.88, "end": 7887.44}, {"text": "mean that there can be an immediate eviction or you don't have rights so the landlord is still going to have to go through um the normal processes if they", "start": 7887.44, "end": 7894.84}, {"text": "want to evict you um if we're uh yeah so I would say nothing really changes in", "start": 7894.84, "end": 7900.079}, {"text": "most cases if you're concerned about that or the landlord is saying you need to get out of here because the building's not up to code the question", "start": 7900.079, "end": 7906.159}, {"text": "is are there repairs that accommodations just because they're very difficult to track um it's harder to get into those buildings as", "start": 7936.719, "end": 7942.84}, {"text": "well but people who are in those types of like perceived precarious housing", "start": 7942.84, "end": 7948}, {"text": "situations um tend to attract more vulnerable people they're usually like the ones most at risk or coming from um", "start": 7948, "end": 7955.88}, {"text": "like Street homelessness and uh in the most like critical housing need and so", "start": 7955.88, "end": 7961.639}, {"text": "having those questions if they don't know their rights about whether they're protected they don't have protections maybe they're not even aware it creates", "start": 7961.639, "end": 7966.76}, {"text": "a lot of uncertainty and so people what we see is like people more coming to with questions about their housing the", "start": 7966.76, "end": 7973.8}, {"text": "leg leg legitimacy of it um often with concerns about like the landlord's", "start": 7973.8, "end": 7979.199}, {"text": "making a claim like your apartment's not fire safe you must move out um and so for those cases we just refer off to the", "start": 7979.199, "end": 7985.44}, {"text": "legal clinic thank you for that so I have two more hopefully I'm still good on time okay um so a a tenant uh let's", "start": 7985.44, "end": 7993.239}, {"text": "say a tenant has received notice from their landlord that the landlord is looking to raise their rent um obviously", "start": 7993.239, "end": 7998.84}, {"text": "this can be an experience that uh for many s is full of fear and anxiety um and the new amount may be", "start": 7998.84, "end": 8006.04}, {"text": "more than they can afford to pay uh is this allowed in all cases is there something the tenant should do um and I", "start": 8006.04, "end": 8013.159}, {"text": "I'll ask Ashley to chime in from a legal point of view yeah thanks Mike so um the", "start": 8013.159, "end": 8018.36}, {"text": "first thing to know is that in order for the landlord to take any increase at all they have to serve you with your proper", "start": 8018.36, "end": 8023.96}, {"text": "N1 notice so a conversation a text uh an email just saying here's what I'd like", "start": 8023.96, "end": 8029.04}, {"text": "to raise your rent to is not proper notice so they need to go through those proper steps and then the other really", "start": 8029.04, "end": 8034.719}, {"text": "important thing for people to know um is the date November 15th 2018 so that's", "start": 8034.719, "end": 8039.88}, {"text": "the date when the the provincial government kind of put a a a limit on rent control so if people are in", "start": 8039.88, "end": 8046.84}, {"text": "buildings that were occupied as residential premises before premises before that date they are subject to", "start": 8046.84, "end": 8052.639}, {"text": "rent control and that means that their rent can only be increased every year by the guideline amount so for 2023 2024", "start": 8052.639, "end": 8059.48}, {"text": "and 2025 that's been 2.5% so that's the maximum rent increase that those folks", "start": 8059.48, "end": 8065.04}, {"text": "can see if you're renting in a new build so there's so many new builds downtown", "start": 8065.04, "end": 8071.8}, {"text": "and I know that a lot of landlords right now are trying to incentivize people to move into those new builds by saying hey", "start": 8071.8, "end": 8077.079}, {"text": "you'll get one month free or two months free but the the real the risk with all", "start": 8077.079, "end": 8082.119}, {"text": "of those new builds is that there is no rent control that your landlord can raise their rent your rent once every 12", "start": 8082.119, "end": 8088.159}, {"text": "months by as much as they want so if that's $100 that's allowed if that's", "start": 8088.159, "end": 8093.36}, {"text": "$200 that's fine if that's $500 that's fine so you're in an extremely risky", "start": 8093.36, "end": 8098.92}, {"text": "position in these new builds that you could just be priced out of the unit by the landlord going through the normal", "start": 8098.92, "end": 8104.84}, {"text": "rent increase process um if you're falling outside of that um that that protection that ended on November uh in", "start": 8104.84, "end": 8111.559}, {"text": "November 2018 um the tenant Support Program specifically helps with above guideline increases so those people who", "start": 8111.559, "end": 8117.8}, {"text": "are protected by rent or by um uh the the guideline increase where they can", "start": 8117.8, "end": 8123.599}, {"text": "only have it raised by 2.5 the landlord can still seek an above guideline increase for specific Capital", "start": 8123.599, "end": 8129.119}, {"text": "expenditures increases in Municipal Taxes and things like that and that's where the tenant Support Program um uh", "start": 8129.119, "end": 8135.44}, {"text": "the funding has helped us be able to support a lot of tenants in big buildings where they're seeing you know the landlord is trying to recoup a", "start": 8135.44, "end": 8141.84}, {"text": "million dollars in costs for balcony repairs and you know boilers and parking", "start": 8141.84, "end": 8147.52}, {"text": "garages and you would think that the landlord's normal profits would those things but they don't and so the", "start": 8147.52, "end": 8153}, {"text": "landlord tries to recoup those costs through the tenants and so the the tenant support program is able to help", "start": 8153, "end": 8158.96}, {"text": "figure out has the landlord done what they're properly supposed to do here are these allowable expenses are they trying", "start": 8158.96, "end": 8164.8}, {"text": "to sneak in things that shouldn't be shouldn't be included and shouldn't be downloaded onto tenants so um um we're", "start": 8164.8, "end": 8170.88}, {"text": "able to help with that but there are some cases where the landlord is allowed to um do increases even above that", "start": 8170.88, "end": 8177.44}, {"text": "regular guideline yeah thank you for uh summing all the that up Ash I know obviously when like policy and", "start": 8177.44, "end": 8183.36}, {"text": "legislation becomes involved it can be it can become very complex really quickly and and so I thank you for explaining that that was very helpful um", "start": 8183.36, "end": 8190.8}, {"text": "so my final uh scenario uh that I'll put to the panel is um let's say a tenant", "start": 8190.8, "end": 8197.28}, {"text": "has fallen to AAR because of circumstances outside of their control or in their personal life that make it", "start": 8197.281, "end": 8202.359}, {"text": "difficult to pay their rent on time and they may fall one two 5 months behind paying their rent um is there something", "start": 8202.36, "end": 8209.359}, {"text": "they can do to ensure they don't lose their home or their rental um and how", "start": 8209.36, "end": 8215.16}, {"text": "like how can they go about doing that so I'll I'll pass it to Katherine because I know housing help center has a program", "start": 8215.16, "end": 8220.92}, {"text": "for that yeah so um one of the main things that we do at the housing help center is", "start": 8220.92, "end": 8226}, {"text": "financial support um and with regards to tenant aers um we're seeing it a lot", "start": 8226, "end": 8231.319}, {"text": "more now with the rising cost of living that a lot more people are kind of on the cusp of not being able to pay their", "start": 8231.32, "end": 8236.638}, {"text": "bills something as small as a flat tire on the way to work can set them back and make them not able to pay their rent if", "start": 8236.639, "end": 8242.24}, {"text": "they're right on the edge of um that kind of vulnerability within the low income cut off um so there are a couple", "start": 8242.24, "end": 8248.399}, {"text": "options that uh the tenants can do one of which is uh communicating with their landlord um making a payment arrangement", "start": 8248.4, "end": 8255.24}, {"text": "if they can this isn't necessarily available to every tenant it does depend on whether or not your landlord is", "start": 8255.24, "end": 8260.8}, {"text": "willing to work with you if you have a a history of paying your rent on time if there are a lot of factors that depend", "start": 8260.8, "end": 8266.8}, {"text": "on that it does look better on the landlord if they do have to file for eviction that they've tried to make make a payment plan so that's a good", "start": 8266.8, "end": 8272.2}, {"text": "incentive for them as well um but in a situation where someone is in rental arear there is the housing emergency", "start": 8272.2, "end": 8278.399}, {"text": "fund um which can assist lowincome uh hamiltonians that are on social", "start": 8278.4, "end": 8283.439}, {"text": "assistance or that are otherwise low income be able to uh pay off their re the overall goal uh of doing that is to", "start": 8283.44, "end": 8291}, {"text": "work on eviction prevention so making sure that we don't have those affordable housing units lost making sure that", "start": 8291, "end": 8297.678}, {"text": "people don't have um a change in their housing they can stay house that we don't have to have a duplication of", "start": 8297.679, "end": 8304.04}, {"text": "services within the Hamilton homelessness sector as well that we are keeping people in their units that's one", "start": 8304.04, "end": 8309.16}, {"text": "less person accessing a shelter bed and staying consistently housed which is a benefit to the community and to the", "start": 8309.16, "end": 8314.359}, {"text": "tenants as well um with regards to financial assistance and kind of focusing on a prevention-based approach", "start": 8314.36, "end": 8321.478}, {"text": "um there's more than just rental aers that can impact it as well um for what we do we if if we have someone coming in", "start": 8321.479, "end": 8328.24}, {"text": "for rental rear and they're on the cusp we look at what can we do external to this to help them build themselves to be", "start": 8328.24, "end": 8333.8}, {"text": "better from a financial perspective have they done their taxes have they um accessed the Ontario electricity Support", "start": 8333.8, "end": 8339.518}, {"text": "Program credit what can we do outside of just the re themselves to help the tenants build their housing to be better", "start": 8339.519, "end": 8346.16}, {"text": "because there's so much more to housing than just the roof over your head and with so many people in that vulnerable category there are a lot of different", "start": 8346.16, "end": 8352.08}, {"text": "options of what we can do um agis are one of the things that this F program focuses on as well and that's something", "start": 8352.08, "end": 8358.359}, {"text": "that the housing emergency fund can help with if um a tenant has a lump sum some of those agis tend to be retroactive for", "start": 8358.36, "end": 8364.96}, {"text": "a couple of years and that can be a really really big financial hardship for somebody that is living with a fixed", "start": 8364.96, "end": 8370.518}, {"text": "income or paycheck to paycheck so that's something that this program can directly benefit and it shows how two City", "start": 8370.519, "end": 8375.84}, {"text": "initiatives are working in tandem to genuinely benefit the community members uh in Hamilton thank you for that Katherine", "start": 8375.84, "end": 8382.84}, {"text": "and uh that will bring us to a
